In April 2014, Richard Kirk murdered his wife Kristine in their Denver home, while their children were present and his wife was on the phone with the 911 operator.
His defense attorney said that he had eaten marijuana candy and that had led him to shoot his wife to death. Earlier this month he pleaded guilty to second-degree murder.
Kirk’s family filed the nation’s first wrongful-death lawsuit against a recreational marijuana company, claiming that Richard Kirk ate a pot-laced Karma Kandy Orange Ginger, a Tootsie-Roll-like chew, that triggered the April 14, 2014, shooting.
Leland Rucker, Sensi magazine senior editor, says that civil suit is unlikely to succeed given that Richard Kirk has plead guilty and is no longer using marijuana in his defense.
